Polar Express & Snow Globe Mini Session Contract
Saturday, December 7th, 2019 and Sunday, December 8, 2019

1. Session Fee of $100 is non-refundable and due in full at time of booking. If you are unable to make your session and you are able to find someone to take your place, you can transfer your spot to that person. This responsibility is yours not the photographers. Sessions will be held in my studio at 501 W Fayette St, Syracuse, NY 13204. Photographer will notify you if the location changes.
2. Session Fee includes time and talent of the photographer, a 20 minute session at my studio, and one digital creation for you to download and print. This session is a quick visit to the studio for a photo, and then the magic happens later during the editing process. The children will not see the Polar Express or the snow globes. All sales are final and non-returnable given the digital nature of this business.
3. You will have the option to purchase prints through my gallery for an additional fee. Your images will be delivered via direct download from the online gallery.
4. The session will last maybe 20 minutes. Please be prompt and ready to go right at your start time. I recommend arriving 5 minutes early for our session. Don’t worry you will have plenty of time to have your pictures taken.
5. Because it can be distracting (especially to small children) and prevents me from being able to do my job effectively, other cameras (cell phone cameras included) are not allowed at the photo session.
6. Sessions are limited to children only. This is not a time for Family portraits. I would be happy to do that for your family at another time.
7. I maintain the right to reschedule or cancel if needed due to illness, emergency, equipment failure and anything out of the control of the photographer. If the sessions need to be cancelled due to unforeseen circumstances on the photographer’s side, client will get a full refund and not be liable for any other monetary issues.
8. Model Release: 
I hereby give to Nicole James Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others: a) To copyright the same in the photographer’s name or any other name that he/she may select; 
b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and; 
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
9. Copyright: Nicole James Photography holds, retains, and maintains all copyrights to all images created during your session. A print release will be included in your digital download given to you for the purpose of making unlimited copies/prints of digital images released from their photo session. They may be printed but not altered in any way, (including cropping of images, editing, or any actions, presets, filters, or textures) for personal display and use only. Images are not to be published in print or on the web, including online social media sites, i.e.: Facebook, Instagram, Twitter or used in commercial advertising or marketing, unless expressed permission is given by Nicole Hiltbrand owner/photographer of Nicole James Photography and photography credit is given to Nicole James Photography, and never to be sold. To ensure that you see my work printed in high quality, I recommend that any prints you order through a consumer lab be made through MPix.com. Any canvases you order I would recommend ordering through canvasondemand.com. I can not guarantee quality of prints if printed elsewhere.
10. Clients are responsible for their children, all family members and themselves at all times during your session and will not hold the photographer, photographers assistants, liable for any injuries or wrong doings.
11. By purchasing this portrait session, I have read, understood, and accept the terms of this contract.
